Please read these Terms and Conditions (“Terms”) carefully before using the website located at technologiesnow.ai (the “Site”) or engaging any services offered by Technologies NOW LLC (“Technologies NOW LLC,” “we,” “us,” or “our”), a limited liability company registered in the State of Colorado.

By accessing our Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

Submitting a form, entering a telephone number, booking an appointment, or agreeing to these Terms does not, by itself, constitute consent to receive SMS or text messages from Technologies NOW LLC.

1. Services

Technologies NOW LLC provides client acquisition, marketing automation, CRM implementation, communication strategy, and related consulting services to businesses across the United States and Canada.

Our services may include, but are not limited to:

• CRM setup, customization, and management

• Marketing and sales automation workflows

• Lead-generation and client-acquisition campaigns

• SMS and email marketing program setup and management

• Podcast guest coordination and outreach

• Business consulting and strategy

Services may be subject to a separate written agreement, proposal, statement of work, or invoice. These Terms apply to visitors, clients, and contacts who interact with Technologies NOW LLC through the Site or other authorized channels.

2. Eligibility

By using this Site or engaging our services, you represent that you are at least 18 years of age, have the legal authority to enter into these Terms, and are not prohibited from doing so under applicable law.

3. Intellectual Property

All content on this Site, including text, graphics, logos, images, videos, software, designs, and other materials, is the property of Technologies NOW LLC or its content licensors and is protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, transmit, publish, display, or create derivative works from content on this Site without our prior written consent.

4. User Conduct

When using our Site or services, you agree not to:

• Violate any applicable local, state, national, or international law or regulation

• Transmit unsolicited or unauthorized advertising or promotional material through our systems

• Impersonate any person or entity or misrepresent your affiliation with any person or entity

• Attempt to gain unauthorized access to any portion of our Site, accounts, systems, or networks

• Engage in conduct that restricts or inhibits another person from using or enjoying the Site

• Introduce a virus, Trojan horse, worm, malicious code, or other harmful technology to the Site

5. Payments and Refunds

Payment terms for services are established in the applicable proposal, contract, service agreement, statement of work, or invoice provided by Technologies NOW LLC.

Unless otherwise agreed in writing:

• All fees are due according to the applicable service agreement or invoice.

• All sales are final unless otherwise stated in a signed agreement.

• Refund requests must be submitted in writing within seven days of the applicable service date.

Technologies NOW LLC reserves the right to suspend or terminate services for nonpayment.

6. Confidentiality

Both parties agree to protect nonpublic, proprietary, confidential, or sensitive information disclosed during the business relationship.

Neither party may disclose such information to a third party without prior written consent, except when disclosure is required by law or reasonably necessary to perform an authorized service under an applicable agreement.

7. Disclaimer of Warranties

The Site and all information, content, and services provided by Technologies NOW LLC are offered on an “as is” and “as available” basis without warranties of any kind, either express or implied.

To the fullest extent permitted by law, Technologies NOW LLC disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Technologies NOW LLC does not warrant that the Site will always be available, uninterrupted, secure, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Technologies NOW LLC and its owners, officers, employees, contractors, and agents shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site or our services.

This limitation includes loss of revenue, profits, business opportunities, data, goodwill, or business interruption, even when Technologies NOW LLC has been advised that such damages may be possible.

Our total liability for a claim arising from or related to these Terms or our services shall not exceed the fees you paid to Technologies NOW LLC during the three months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Technologies NOW LLC and its owners, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from:

• Your use of the Site

• Your violation of these Terms

• Your violation of applicable law

• Your infringement or violation of another person’s rights

10. Third-Party Links and Services

Our Site may contain links to third-party websites, platforms, applications, or services.

These links are provided for convenience only. Technologies NOW LLC does not control, endorse, or assume responsibility for the content, availability, security, terms, or privacy practices of third-party services.

Your use of third-party websites and services is subject to their respective terms and policies and is undertaken at your own risk.

11. SMS Messaging Terms

Technologies NOW LLC operates an SMS messaging program for contacts who have affirmatively and voluntarily opted in to one or more specific categories of messages.

Providing a mobile telephone number alone does not enroll a person in the SMS messaging program.

Program Description

Depending on the consent separately selected by the user, Technologies NOW LLC may send the following categories of SMS messages:

Marketing messages may include:

• Special offers and promotions

• Information about Technologies NOW LLC services

• Sales-related follow-up

• Client-acquisition and automation opportunities

• Invitations to schedule an AI Playbook session

• Other promotional service updates

Non-marketing messages may include:

• Appointment confirmations

• Appointment reminders

• Rescheduling information

• Customer-support communications

• Follow-up concerning information specifically requested by the user

• Podcast interview scheduling and coordination

• Service-related or account-related updates

Messages may be sent from our business telephone number, (720) 605-0609, or another telephone number properly registered to Technologies NOW LLC.

Consent and Opt-In

Submitting a form, entering a telephone number, or booking an appointment does not automatically enroll you in SMS messaging.

Where text messaging is offered, you may separately and voluntarily select the applicable SMS consent checkbox.

Marketing and non-marketing SMS consent are presented separately when both message categories are offered. You may choose to consent to one category, both categories, or neither category.

SMS consent is optional, is not preselected on our forms, and is not a condition of purchasing a product or receiving a service from Technologies NOW LLC.

Technologies NOW LLC sends only the categories of messages affirmatively selected by the user.

By selecting an SMS consent checkbox, you confirm that you are the subscriber, account holder, or authorized user of the mobile telephone number provided and that you authorize Technologies NOW LLC to send the selected category of messages to that number.

Separate Marketing and Non-Marketing Consent

Consent to receive marketing text messages is separate from consent to receive non-marketing text messages.

Consent to receive one category of SMS messages does not constitute consent to receive the other category.

A user who does not select an SMS checkbox may still submit an applicable form, book an appointment, request information, or purchase services.

Separate Telephone-Call Consent

SMS consent is separate from consent to receive automated, prerecorded, artificial-voice, or AI-generated telephone calls.

Selecting an SMS consent checkbox does not, by itself, provide consent to receive automated or AI-generated calls. Where telephone-call consent is requested, it will be presented separately.

Message Frequency

Message frequency varies depending on the category of messages selected, your appointments, your requests, and your interactions with Technologies NOW LLC.

You may receive multiple messages per week during active scheduling, service, support, or sales conversations. Message frequency may decrease when there is no active interaction.

Message and Data Rates

Message and data rates may apply.

You are responsible for charges imposed by your wireless carrier for sending or receiving text messages. Contact your wireless carrier for information about your messaging and data plan.

How to Opt Out

You may withdraw your consent and cancel SMS messages from Technologies NOW LLC at any time.

Reply STOP to any text message from Technologies NOW LLC to unsubscribe from future SMS messages.

After replying STOP, you may receive one final message confirming that your opt-out request has been processed. No additional messages will be sent to that number unless you subsequently provide new affirmative consent.

Where supported, you may reply START to request that messaging resume.

Opting out of SMS messages does not cancel an appointment, terminate a service agreement, or prevent you from communicating with Technologies NOW LLC through other methods.

No Third-Party Sharing of SMS Data

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be disclosed to subcontractors and service providers that support the operation and delivery of our messaging program, such as telecommunications carriers, messaging aggregators, technology-platform providers, and customer-support providers, but only as reasonably necessary to provide those services.

Text-messaging originator opt-in data and consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

All other categories of information-sharing described in our Privacy Policy exclude SMS opt-in data and consent except when disclosure is required to operate the messaging service, comply with applicable law, protect legal rights, or respond to a valid governmental request.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Technologies NOW LLC is not responsible for delays or failures in SMS delivery caused by wireless carriers, unavailable networks, incompatible devices, inaccurate telephone numbers, or circumstances outside our reasonable control.

Changes to the SMS Program

Technologies NOW LLC may modify or discontinue part or all of its SMS messaging program at any time.

Material changes affecting how SMS consent or mobile information is handled will be reflected in these Terms or our Privacy Policy.

12. Privacy Policy

Your use of the Site and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

The Privacy Policy explains how Technologies NOW LLC collects, uses, protects, retains, and discloses personal information, including mobile telephone numbers, SMS opt-in records, and messaging consent.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict-of-law principles.

The parties agree to attempt to resolve disputes arising from these Terms or our services through good-faith negotiation.

If negotiation is unsuccessful, the dispute shall be resolved through binding arbitration in Broomfield, Colorado, in accordance with the applicable rules of the American Arbitration Association.

Nothing in this section prevents either party from seeking temporary, injunctive, or other equitable relief from a court of competent jurisdiction when appropriate.

14. Changes to These Terms

Technologies NOW LLC may modify these Terms periodically.

Material changes will be posted on this page with an updated effective date. Your continued use of the Site or services after revised Terms become effective constitutes acceptance of those revised Terms, except that continued use does not independently constitute consent to receive SMS messages.

New or materially different categories of SMS messages will require the applicable affirmative consent before those messages are sent.

15. Entire Agreement

These Terms, together with our Privacy Policy and any executed service agreement, proposal, statement of work, or other written agreement, constitute the entire agreement between you and Technologies NOW LLC regarding the applicable subject matter.

These documents supersede prior agreements, representations, communications, and understandings concerning that subject matter.
